Sam Smith, Anne Foster, and Jaimee King founded Smith Foster King in 2022 with a shared commitment to excellent lawyering, sound judgment, and genuine respect for the people we represent. How do I know if I have a case?

You do not need to figure that out before calling us. We start by listening, asking questions, and looking at what happened, the harm involved, and what evidence may exist. Sometimes we can offer a view based on that conversation. Other times, more investigation is needed.

When should I call an attorney?

Usually sooner than people think. Calling a lawyer does not mean you need to start a case. But evidence can disappear, memories can fade, and deadlines can pass. An early conversation can help identify what needs attention now and what can wait.

Will one lawyer handle my case, or will I work with the whole firm?

You will have a team that knows your case closely and stays close to the work. But we do not work in isolation. We discuss strategy, challenge assumptions, test ideas, and draw on the judgment and perspective of others at the firm as the case develops. Our size makes that kind of collaboration natural. It is an important part of how we work.

Does hiring a trial lawyer mean my case will go to trial?

No. Trial is one tool, not the objective. Many disputes are better resolved another way: through negotiation, mediation, arbitration, or motion practice. But preparing a case with trial in mind from the outset creates options. It can expose weaknesses, strengthen your position, and help us evaluate opportunities for resolution as they arise. If trial becomes necessary, the preparation has already begun.

Do I need a large law firm to go against a large company?

We have substantial experience litigating against well-resourced defendants: companies, institutions, employers, insurers, and others. Some of our largest recoveries have come from those cases. We understand the resources they can bring to a dispute and the preparation required to meet them. We focus on what matters: developing the facts, building the evidence, anticipating where the case will be challenged, and preparing to see it through.

What kinds of cases does Smith Foster King handle?

We represent individuals, families, businesses, and others in serious civil disputes. Our work includes personal injury and wrongful death, employment and civil rights, medical malpractice, abuse and neglect, and business litigation. Not every case fits neatly into a category. When a matter calls for experience outside our firm, we may work with other lawyers or help connect you with someone better suited to it. The important thing is finding the right approach and the right team for the problem at hand.

Does Smith Foster King handle personal injury cases involving Topgolf?

Yes. We have represented multiple people who suffered traumatic brain injuries at Topgolf's Hillsboro, Oregon facility in cases involving alleged safety failures.

In one case, a child suffered a skull fracture and traumatic brain injury after being struck by a golf club. We presented evidence that Topgolf knew guests had previously been struck by clubs and balls, and a federal jury returned a verdict of more than $15.7 million. Before the punitive damages phase, the case settled for the full amount of the verdict plus additional compensation.

In another case, a young Oregon woman suffered a traumatic brain injury when a club flew from another bay and struck her while she was seated with friends. That case resolved for a multi-million dollar amount. We are also currently pursuing another personal injury case against Topgolf in federal court.

Does Smith Foster King handle employment discrimination and sexual harassment cases?

Yes. SFK represents employees in serious cases involving sexual and racial harassment, discrimination, and retaliation.

In a recent case, SFK represented a woman who alleged that her supervisor subjected her to months of racial and sexual harassment, including slurs, unwanted physical contact, and threatening behavior. She alleged that her employer knew of numerous prior complaints and, when she reported the conduct, investigated her own job performance instead. The case resulted in a $1.155 million recovery for our client.
